The Seminole County Board of Commissioners held their regular monthly meeting on Tuesday, April 12, 2011 in the Superior Courtroom located on the second floor of the courthouse. Those present were, Chairman Tommy Rogers, Vice-Chairman Dell Shingler,  Commissioner Brenda Peterson, Commissioner Roger Lane, County Manager/Clerk Donna Jones, and several interested citizens.  Commissioner Scott Miller was absent.



The regular monthly meeting was called to order by Chairman Tommy Rogers.


The invocation was offered by Commissioner Dell Shingler.


Minutes from the Regular Monthly Meeting held on March 8, 2011 and the March 15, 2011 called meeting were approved on a motion by Commissioner Dell Shingler, seconded by Commissioner Scott Miller. Motion passed.


The February, 2011 Financial Statement was approved on a motion by Commissioner Scott Miller, and seconded by Commissioner Brenda Peterson. Motion passed.


Committee Reports.


Chairman Rogers reported that County Attorney, Kenneth Hornsby, is in the process of preparing the right-of-way acquisition documents for the two private owners along the Burke Road Bridge project. The Corps of Engineers should have their documents to us within 30 days. The bridge project is due to be let by GDOT in July.


Rogers continued that the south wall on the bridge repair project in Treasure Lake Subdivision has been poured and the north wall framing is almost complete and is being readied for concrete.


Old Business:


All responses to the bid request for engineering services on the courthouse grounds have been received and are as follows:

Commissioner Roger Lane made the motion to select Watkins & Associates of Tifton to perform the engineering services for the drainage project on the courthouse grounds. Watkins had done preliminary work on the project some years back. Commissioner Dell Shingler provided the second. Motion passed.


Commissioner Brenda Peterson made the motion to allow an inmate to cut up for scrap an old aluminum scrap refuse trailer at the Transfer Station. The trailer had originally been listed on GovDeals as surplus property but did not sell. Commissioner Roger Lane asked if the inmate would be covered by our insurance in case of accident. County Administrator Jones replied yes, he would be covered under the inmate policy.

Commissioner Dell Shingler provided the second. Motion passed.


Administrator Jones reported that the vendors she had contacted have been unable to locate low mileage used fleet trucks to replace two high mileage 1995 trucks at the road department. Vendors who searched for used vehicles were Brannen Motors; Donalsonville Motors; Riverbend Ford; and Bondy’s Ford. After failing to find used trucks, Jones went back to the vendors and asked for quotes on a new truck.

After discussion, Commissioner Dell Shingler made the motion to wait until in the morning when we are to receive the bid from Donalsonville Motors and then go with the low bidder to purchase one truck. Commissioner Roger Lane provided the second. Motion passed. In six months the commission will re-visit the issue to purchase a second truck.

The low bidder was Bondy’s Ford of Dothan, AL at $19,127.

New Business:


The Southwest Georgia Regional Commission (SWGRC) has submitted their annual request for our support for their annual resolution to apply for rural transit 5311 DOT funds for community transportation. Commissioner Brenda Peterson made the motion approving the Chairman’s signature on behalf of the full commission. Commissioner Dell Shingler provided the second. Motion passed.


The Commission discussed the implementation of a timber harvesting permit and ordinance. County Attorney, Kenneth Hornsby, had approved the wording of the Ordinance but questioned if the $500 fine was enough to discourage abuse. The Commission tabled the issue until next month in order to set-up a fine scale for multiple infractions rather than the flat $500 fine as the Ordinance draft currently reads.


Georgia Pines has submitted a request for $20,000 from the Drug Fund to defray costs of treating patients for substance abuse. The Commission asked if all the funds would remain in Seminole County and Sheriff Elliott asked why his department has to pay Georgia Pines for mental evaluation/treatment of inmates if the County makes this contribution. In the past the County was not charged for inmate services, however, recently we have been receiving bills for services. On a motion by Commissioner Brenda Peterson and second by Commissioner Dell Shingler, the Commission tabled the item until next month and asked that a representative from Georgia Pines come to present the request and be available for questions.


The Commission will need to respond to the HB277 Transportation Special Local Option Sales Tax (TSPLOST) request to list a regional project with the GDOT. The TSPLOST tax will be listed on the March 2012 referendum. The list of projects for the Southwest Georgia Region must be submitted to the Regional Commission by March 23rd. Jones recommended submitting the design, engineering and right-of-way process to four lane Highway 91 from the Florida line to the City of Donalsonville, and continue from the north city limit line to the Miller County line. This would allow Hwy 91 to be used as a hurricane evacuation route out of Florida. The project we submit must be a bridge or state road corridor project that connects cities or counties and will be for the next ten years of State road projects.

Commissioner Lane stated that he would go along with the project, however , there is no guarantee that the voters will pass the referendum in 2012 or to approve the construction of the project in 2022 . Jones stated that we could not guarantee the project will make it through the final selection process but wanted to submit a project for consideration that would benefit the citizens of Seminole County.

Commissioner Lane made the motion to submit the project with Commissioner Dell Shingler providing the second. Motion passed.

The unconstrained list of projects submitted by the Regional Commission will be presented to the State for review and then passed back to the regional board to pare down to the amount of dollars that will be estimated for the region over the next ten years. This constrained list will then be put to the voters in the March 2012 referendum.





Chairman Rogers reported that the “Renew Our Rivers” campaign will take place from March 17th through the 19th. On Saturday the 19th participants are asked to gather at the new group shelter at the State Park at 8:00 a.m. in order to receive T-Shirts; gloves; trash bags etc.  Also, lunch will be provided on Saturday at the pavilion at noon.

Citizens who are interested in participating in the campaign are asked to call the Chamber of Commerce at 524-2588 in order to be able to obtain a head count for lunch.




Administrator Jones reported that members of the Commission and Donalsonville Council will be meeting with the local government liaison from ACCG, Dave Wills, at City Hall on Friday, March 18, 2011. The purpose of the meeting is to investigate ways the city and county may be able to consolidate services. Mr. Wills has stated that he would be willing to discuss any issue the County is facing where ACCG could be of service.


On a motion by Commissioner Brenda Peterson and second by Commissioner Dell Shingler the Commission entered into Executive Session for a legal matter. Motion passed.


On a motion by Commissioner Dell Shingler and second by Commissioner Brenda Peterson the Commission exited the Executive Session and re-entered the General Session. Motion passed.


In response to the Country Club’s request to have the County lease the country club and run it as a public course, Commissioner Roger Lane made the motion to deny the request. The second was provided by Commission Dell Shingler. Motion passed.






With no further business to discuss, the meeting was adjourned on a motion made by Commissioner Brenda Peterson, seconded by Commissioner Dell Shingler with Commissioner Roger Lane and Chairman Tommy Rogers voting yes.
