SEMINOLE COUNTY BOARD OF COMMISSIONERS

CALLED MEETING

SEMINOLE COUNTY COURTHOUSE, SECOND FLOOR, LAW LIBRARY

THURSDAY, FEBRUARY 26TH, 2015

1:00 P.M.

                                                     

The Seminole County Board of Commissioners held a Called Meeting on Thursday, February 26th, 2015 in the Law Library at the Courthouse. Those present were Chairman Chuck Orrick, Vice Chairman Brenda Peterson, Commissioner Roger Lane, Commissioner Darius Culverson (by phone), Commissioner Shelia Williams, and County Manager/Clerk Paula Granger.  The purpose of the meeting was to discuss property taxes for American Peanut Growers Group.  Mr. Terry Shamblin, Mr. Ward Trulock, and Mr. Scott Miller were in attendance representing APGG.  

               Chairman Orrick called the meeting to order.

Commissioner Lane gave the invocation followed by the Pledge of Allegiance.

Roll call was conducted and a quorum was established.

               County Manager Granger explained that APGG received a letter from Tax Commissioner Leslie Johnson dated January 26, 2015 indicating their taxes were delinquent for 2012 and 2013.  It was determined the Freeport application for 2012 was not submitted by APGG; however, APGG has stated they never received bills for either year until delivery of the delinquent notice.  Due to the circumstances surrounding the failure to submit the Freeport application and an ongoing audit at APGG conducted by Ms. Fannie Barber, there are several items to consider in regard to the correct amount due for 2012 taxes.  Freeport exemption would decrease the 2012 bill by approximately $100,000.  APGG has paid the 2013 bill.    

 

Commissioner Lane stated the 2012 digest was all out of kilter due to another Freeport error with Staple Cotton.  Commissioner Lane stated he specifically asked Ms. Barton and Ms. Barber in 2012 to make certain that all Freeports were filed and reflected on the digest.  Both responded all Freeports had been received and were reflected on the digest accordingly.  Commissioner Lane stated he did not understand how this was missed since there are only a handful of Freeports each year. 

 

Ms. Barton and Ms. Barber both commented on their actions regarding Freeports and made the Board aware that Freeport apps are now sent out by certified mail to track delivery.  Mr. Trulock stated he wasn’t aware the audit had been completed since he did not receive a notice and wasn’t given any details of the audit.  Ms. Barton stated audit details are not provided. 

 

County Manager Granger stated the county attorney will need to get involved in this process to determine the legal rights of the Board of Commissioners to adjust a tax bill, or relieve taxes due to a Freeport error. 

 

               A motion to table the item was made by Commissioner Lane and a second was given by Vice Chairman Peterson.  All in favor, motion passed.

 

               A motion to adjourn was made by Commissioner Lane.  A second was given by Chairman Orrick.  All in favor, motion passed.
